IF YOU PURCHASED AND PAID ALL OR A PORTION OF A DEBT CANCELLATION PRODUCT (“DCP”) FROM MARLIN FINANCIAL YOU MAY BE ENTITLED TO MONETARY COMPENSATION
SUMMARY OF CONSENT FINAL JUDGMENT: You may be an Eligible Borrower pursuant to a Consent Final Judgment in Office of the Attorney General, State of Florida, Dept. of Legal Affairs v. Marlin Financial, Inc. and may qualify for a refund of DCP paid from a compensation fund (“Fund”) established by settlement in this case. Marlin Financial (“Defendant”) offered and sold DCPs to consumers (the "Borrowers") in connection with auto loans made by the Defendant to these Borrowers. The Office of the Attorney General alleged that Defendant’s practice of offering and selling the DCP to these Borrowers was an unfair and deceptive practice. Defendant denied these claims and alleged that a lender's right to offer and sell the DCP in connection with the loans was a proper and accepted practice that was disclosed on the contract documents. Defendant stipulated to a temporary injunction that was entered by the court on November 29, 2018, where, among other things, Defendant agreed to cease the offering of DCPs to borrowers, ceased charging interest on DCPs, and ceased collection of any other monies allegedly due pursuant to the DCPs. There has been no determination of who is right or wrong. If you are a Borrower, you may be entitled to receive a cash payment from the Fund as a result of your purchase of the DCP. You may also be entitled to compensation if your car was repossessed and sold in order to pay all or a portion of the DCP. The Fund is NOT available for the return of principal or interest payments on loan amounts.
WHO IS ELIGIBLE? The Consent Final Judgment includes all Borrowers who purchased and paid all or a portion of a DCP from Marlin Financial between January 1, 2016 to August 23, 2022 (“Eligible Borrowers”). You are receiving this Notice because records show that you may be an Eligible Borrower.
HOW DO I SUBMIT A CLAIM FORM? To receive a refund of DCP paid, you must submit the Claim Form on the preceding page to the American Legal Claim Services LLC (“Claims Administrator”) on or before May 27, 2023. You may submit a Claim Form by U.S. Mail to the Claims Administrator at Post Office Box 23459, Jacksonville, FL, or online. If you send a Claim Form by U.S. Mail, it must be postmarked by May 27, 2023. Claim Forms submitted online must be submitted by 11:59 PM on May 27, 2023.
COMPENSATION TERMS: Eligible Borrowers who submit timely, valid, correct and verified Claim Forms by the Claims Deadline shall be sent a Claim Settlement Check by the Claims Administrator pursuant to the terms of the Consent Final Judgment. The Claims Administrator is empowered to review and VERIFY claims. Eligible Borrowers will be sent refunds to the address they submitted on their Claim Form within 30 days.
